Posted in Fertility Experts on September 20, 2022 by Donor Concierge

How to find a gestational carrier in Oklahoma? Are there specific fertility laws in Oklahoma? Attorney Christina Miller of Reproductive Family Law Center gives us a quick explainer of surrogacy in the Sooner State.

Donor Concierge works with many clients to find qualified surrogates, but we know how important it is to work with a fertility attorney during the surrogate process for all contracts and legal considerations. Laws around fertility and third party reproduction are evolving, and it is vital to work with a specialized fertility attorney who can walk you through all legal considerations during surrogacy, including conception, pregnancy, birth, parentage, and more.

If you are looking to find an Oklahoma surrogate, we are here to help – but first, you can review Oklahoma legal considerations for surrogacy below. Thank you to attorney Christina Miller of Reproductive Family Law Center for sharing this overview of Oklahoma surrogacy law below!

Enforcement of Agreements
In Oklahoma, a surrogacy agreement (Agreement) is enforced under the Gestational Agreement Act (the Act). The Act outlines the required information contained in the Agreement.

Establishment of Legal Parentage
The Act allows Parent to secure legal parentage by the court validating the terms of the Agreement before transferring the embryo to the Gestational Surrogate.

Birth Certificates, Social Security Number and Passport
Oklahoma Vital Records office honors Oklahoma court orders and will prepare an amended birth certificate based off the validation of the Agreement under the Act. Reproductive Family Law Center handles obtaining copies of the birth certificate and will prepare the paperwork necessary for families to obtain social security numbers and passports for the child.

The foregoing constitutes general information provided to prospective clients and may not apply in all situations. All prospective participants should consult with a lawyer about their individual factual circumstances. The choice of a lawyer is an important decision and should not be based solely upon advertisements. Receipt of this document from any source does not, by itself constitute the establishment of an attorney-client relationship.
